PRIVACY POLICY

§1 Who is the Administrator of your personal data?

§2 For what purpose do we collect your data, and how long do we store it?

We may process your data for the following purposes:

  1. Communication with you, including responding to questions submitted via the contact form, email, etc.

The data will be processed based on the legitimate interest of the Administrator in the form of communication with the Users of the Website (Article 6(1)(f) RODO). Your data will be processed no longer than until you raise an objection, or the business purpose ceases. Provision of this data is voluntary but necessary for communication with you. Data may also be archived for internal purposes based on the Administrator’s legitimate interest (Article 6(1)(f) RODO) until you raise an objection, or the business purpose ceases.

  1. Concluding a contract and its execution (placing an order).
  2. Determination, defense, and pursuit of claims
  3. Fulfillment of legal obligations incumbent on the Administrator (including tax and archiving obligations).

The data necessary for the conclusion and performance of the contract will be processed for the duration of the contract, including the time of the exercising of contractual rights, such as the right of complaint under warranty (Article 6(1)(b) and (f) RODO). The provision of this data is voluntary but necessary for the conclusion and execution of the contract.

Additional data provided for the purpose of, among others, facilitating the performance of a contract will be processed no longer than until you raise an objection, or the business purpose ceases based on the legitimate interest of serving customers (Article 6(1)(f) RODO).

After this period, the data will be processed for the period of the statute of limitations for claims based on the Administrator’s legitimate interest in defending against claims, as well as for the purpose of establishing and asserting claims (Article 6(1)(f) RODO).

In case the data is necessary to fulfill the legal obligations incumbent on the Administrator (e.g., issuing and storing invoices) – the data will be processed for this purpose for no longer than six years (archiving obligations regarding accounting documents) unless the law requires a longer period (Article 6(1)(c) of the RODO).

Data may also be archived for internal and statistical purposes until you raise an objection, or the business purpose ceases based on the Administrator’s legitimate interest (Article 6(1)(f) of the RODO).

  1. To provide marketing information (including sending a newsletter and information about services, products, promotions, and free content via other tools, e.g., chatbot, by phone).

Your data will be processed based on the Administrator’s legitimate interest in marketing the Administrator’s products and services (Article 6(1)(f) RODO). Your data will be processed no longer than until you raise an objection, or the business purpose ceases – whichever comes first. The provision of data is voluntary but necessary to receive marketing/commercial information. 

For the purposes of commercial and telephone communication, we need your consent in accordance with Article 10 of the Law on Provision of Electronic Services. You can withdraw it at any time by clicking the link in the footer of the email or by writing to us at the address given above.

  1. Administration and management of the website and groups on social platforms (including Facebook (Meta), Instagram, LinkedIn) in the case of data processing on social platforms, including communication with you, directing marketing content to you.

The data will be processed only when you decide to like the page / join the group / select the “Follow” option or otherwise leave your data on the platform managed by us, such as posting a post or comment. The data will be processed for the period of existence of the page/group or until you raise an objection, which may be done by clicking the “Like”, “Follow” option, deleting the comment/entry, or otherwise as provided within the platform/page or by contacting us.

Please be advised that the rules relating to the page/fan page/group are set by the Administrator, while the rules for the use of the social networking site on which the page/fan page/group is placed are set by the entity managing these services.

  1. Analytical and statistical purposes

Data processed for analytical and statistical purposes, consisting in particular of the analysis of data obtained automatically when using the Website, including cookies, are processed based on the Administrator’s legitimate interest in adapting the content of the Website to the User’s preferences and optimizing the use of the Website; creating statistics that help to understand how Users use the Website, which allows improving its structure and content (Article 6(1)(f) RODO). Data may also be archived for internal and statistical purposes until you raise an objection, or the business purpose ceases based on the Administrator’s legitimate interest (Article 6(1)(f) RODO).

  1. Recovery of abandoned shopping carts

In case you do not complete your order, you will receive a reminder about the initiated but not finalized order. The data will be processed based on the Administrator’s legitimate interest in serving potential and existing customers (Article 6(1)(f) RODO). The data will be processed for the time necessary to fulfill business purposes or to raise an objection.

  1. Posting comments

With respect to the data visible on our Website when you post a comment, this data is processed by us to administer and operate the Website and to communicate with you based on the Administrator’s legitimate interest (Article 6(1)(f)) for the time necessary to fulfill business purposes or to raise objections.

  1. Promotion and marketing

If you provide us with your data, in particular in the form of an opinion regarding a product or service, including image data, the data will be processed based on the Administrator’s legitimate interest in marketing the Administrator’s services and products and improving their quality. The data will be processed for the time necessary to fulfill business purposes or to raise an objection. The provision of data is voluntary.

  1. Recruitment

The data may be processed for the time necessary for the recruitment process and conclusion of a contract (Article 6.1.b and 6.1.c RODO), and in the case of additional data provided voluntarily – based on your consent; for future recruitment purposes – based on your consent, for a maximum period of 3 years (this period counts from the end of the year in which the application was obtained). Provision of personal data is voluntary, except that the provision of certain data may be necessary for recruitment, as well as for the conclusion of a contract. As a consequence of failing to provide such data, it will be impossible to carry out the activities as mentioned earlier.

§3 Who can we share your data with?

We will transfer your data to other entities only if it is necessary to achieve the purposes of the processing referred to in §2 and only to the extent required to accomplish that purpose. As a rule, we only collect and process the data you provide, subject to data collected automatically (cookies). You can find more about cookies in §7.

If necessary, your data may be transferred to entities with which we cooperate in the implementation of the above purposes, in particular, to a hosting company, an IT company/website management entity, a company providing accounting and bookkeeping services, a company providing invoicing software, a company providing newsletter services, a company providing cloud services, entities providing marketing services, entities providing administrative services, entities providing consulting services, subcontractors, lawyers, couriers or postal operators, training platform, social networking platform, customer service platform, appointment scheduling platform, a platform for providing products or services, other entities that support the Administrator in achieving the purposes of the processing.

As a rule, data will not be transferred outside the EEA except as described below. In other cases, where data will be transferred outside the EEA, this will be based on your consent, standard contractual clauses, or based on other safeguards provided for in the GDPR after compliance with, among other things, information obligations.

The services provided by Google or Facebook (META) are generally provided by entities based in the European Union. However, due to the global nature of these entities’ operations, your data may be transferred to the USA in connection with its storage on US servers (in whole or in part). Regardless, Google and Facebook have implemented safeguards under the GDPR to protect your personal data in accordance with the requirements of the GDPR through the use of standard contractual clauses. For more information on the data processing policies of the above providers, please refer to the Privacy Policies of each entity.

§4 What are your rights?

In connection with the RODO, you have the right to:

  • access to your personal data,
  • rectification of personal data,
  • deletion of personal data,
  • restrictions on the processing of personal data,
  • objection to the processing of personal data,
  • transfer of personal data,
  • withdrawal of consent; withdrawal of consent does not affect the lawfulness of the processing carried out before its withdrawal.

If you believe that your personal data is processed contrary to applicable law, you have the right to lodge a complaint with the President of the Office for Personal Data Protection (in Polish: Prezes Urzędu Ochrony Danych Osobowych). In this case, however, I encourage you to contact us in advance to clarify your concerns.

§5 Is your data profiled?

The Administrator analyzes personal data by automated means using tools provided by software providers (e.g., using statistics, history) only to the extent that it has no legal effect on you or similarly significantly affects your situation, including your rights or freedoms. The purpose of data processing by automated means is for us to learn about Users’ preferences (more about analysis is indicated in the Cookie Policy section).

§6 The provisions of the law applicable to personal data

In matters not regulated, the relevant provisions of law, including European law (including the GDPR), shall apply.

§7 Cookie Policy

The site does not automatically collect any information except for the information contained in cookies. Furthermore, this data is collected in a way that prevents identification of the User, the so-called Anonymous Data.

Cookies are IT data, in particular text files, stored on the Website User’s terminal device and intended for using the Website. Cookies usually contain the name of the website they come from, their storage timestamp on the end device, and a unique number.

Cookies are used to adapt the site’s content to the User’s preferences and to optimize the use of the Site; to create statistics that help to understand how Users use the Site, which allows to improve its structure and content.

You can make changes to your cookie settings. Your web browser often allows cookies to be stored on your end device by default. Detailed information about the possibility and methods of handling cookies is available in the settings of your software (web browser). Lack of consent for cookies may limit the operation of certain functionalities on the Site.

The Administrator uses technologies that observe the actions taken by the User on the Site:

  • Facebook Conversion Pixel (Meta) provided by Meta Platforms Ireland Limited- to manage ads on Meta services and conduct remarketing activities; the Facebook Pixel is a piece of code published on a website that allows reaching a target group based on the data of people who have used the website. As part of the Facebook Pixel function, it is, therefore, possible to display published advertisements on the sites belonging to Meta only to users of the their services who have shown interest in the products or services or have common factors with the aforementioned people. This data is processed based on the legitimate interest of the Administrator (Article 6(1)(f) RODO).   • Google tools, including Google Analytics, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We use the data obtained through the aforementioned tool to analyze the site’s statistics. Google Analytics uses its own cookies to analyze site users’ activities and behaviors. These cookies are used to store information, e.g., from which page the User came to the current website. They help improve the Site; This data is processed based on the Administrator’s legitimate interest (Article 6(1)(f) of the RODO). §8 Social plug-ins

The Site uses plug-ins, widgets, links, and other social tools provided by portals such as Facebook (Meta), Instagram, Google, YouTube, LinkedIn, and Calendly. The rules regarding processing personal data are described directly on the websites of the aforementioned Service Providers.

§9 Co-administration

The data processed for the purposes of statistics collected on the Facebook Platform (Meta) is co-managed by the Administrator and Meta Platforms Ireland Limited, with its registered office at 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, hereinafter referred to as the Co-Administrator. Detailed rules regarding data co-management, including information on your rights, are described on the Privacy Policy page.

Data processed on the LinkedIn platform is co-administered by the Administrator and LinkedIn Ireland Unlimited Company, address: Legal Dept. (Privacy Policy and User Agreement), Wilton Place, Dublin 2, Ireland, hereinafter referred to as the Joint Controller. The details of the data co-management, including information on your rights, are described on the Privacy Policy page.

The data processed within the WebToLearn platform are co-administered by the Administrator and WEB TO LEARN SP. Z O.O. UL. PRZEMYSŁOWA 3 83-400 KOŚCIERZYNA NIP 5911709438, hereinafter referred to as Co-administrator. The buyer pays for the products through the payment methods made available by EasyCart. Payments for products are made in accordance with the terms and conditions of the payment operator, Stripe, available at https://stripe.com/en-pl/privacy. Data processed as part of the sale of products is co-administered by the Administrator and:
